TERMS OF USE

By creating an account or playing UnderGrow ("the game"), you accept these terms. If you do not agree, do not use the game.

1. Who provides the game

UnderGrow is developed and operated by UnderGrow Team, under the responsibility of Ivan Bee ("the responsible parties"). Contact: contacto@undergrowgame.com.

2. Age

To play, you must be 18 years of age or older. If we discover that a user is a minor, we will close their account and delete their data.

3. Your account

• The account is personal: one person, one account. You are responsible for everything that happens with it and for safeguarding your password.
• It is prohibited to use several accounts to benefit yourself (buying from yourself, hiring yourself, partnering with yourself or attacking yourself). Accounts used from the same browser are linked and cannot interact with each other. If you share a computer with another person, you may both still play.
• Accounts may not be created with disposable ("throwaway") email addresses, and an automated anti-bot check (Cloudflare Turnstile) is used when creating or logging into an account.

4. What is not allowed

• Using the game, the chat, the names or the images to offer, buy or arrange real sales of any substance.
• Sharing contact details (phone numbers, emails, links, usernames on other apps).
• Posting content that is illegal, violent, sexual, discriminatory, that harasses another person or that uses someone's data without permission.
• Cheating: automated programs, deliberately exploiting game bugs, attacking the server or attempting to access other people's accounts.
• Impersonating another person, the people responsible for the game or a real brand.

5. Content posted by players

Grower names, company names and strain names, images, logos and chat messages are the sole responsibility of the person who posts them. By posting them, you allow us to display them within the game to other players. The chat is public, is stored and may be read by the administrator.

6. Virtual items have no monetary value

The money, plants, containers, strains, partnership shares, trophies and everything else in the game are fictional: they have no real value, cannot be exchanged for money or for anything real, and do not belong to you outside the game.

7. Moderation and sanctions

The administrator may delete messages, remove images, logos or strains, ask you to change a name, mute you in the chat or close your account, without prior notice, if you do not comply with these terms. Real sales or contact details are grounds for immediate closure and may be reported to the authorities.

8. The game may change

The game is under development. We may change its rules, its internal prices and its balance, reset seasons or saved games, or stop offering it, at any time.

9. No warranties

The game is provided "as is", free of charge, with no guarantee that it will always work or be error-free. To the extent permitted by law, the responsible parties are not liable for the loss of saved games or game data, or for what other players do.

10. Changes to these terms

If we change these terms, we will update the date above and, if the change is significant, notify you in the game. If you keep playing after the notice, you accept the new terms.

11. Governing law

These terms are governed by the laws of the Argentine Republic. Any dispute will be resolved before the ordinary courts of the City of Mendoza, Province of Mendoza, unless consumer protection law entitles you to a different venue.

PRIVACY POLICY

Here we explain what data UnderGrow stores, for what purpose and what you can do with it. We apply Law No. 25.326 on the Protection of Personal Data of the Argentine Republic.

1. Data controller

The data controller is UnderGrow Team, under the responsibility of Ivan Bee. For any request regarding your data, write to contacto@undergrowgame.com.

2. What data we store

• Your account: your email and your password. The password is stored encrypted: no one, not even the administrator, can read it.
• Your grower: the name you choose, your country and your province or state, and the image you upload, if you upload one.
• Your saved game: everything you do in the game (plants, sales, employees, partnerships, attacks, trophies), so that the game works the same on any device.
• The chat: the messages you write, with the date and your grower name.
• A browser number: a random number that the game stores in your browser to detect accounts used from the same place. It is sent to our server together with your account, but it says nothing about you: it is not your name, your location or a "fingerprint" of your computer.
• Technical data: like any website, the servers record for a period of time the IP address, the date and the browser type of each request, for security and to fix errors.

We do not ask for your real name, your ID document, your phone number, your address or payment details, and there is no advertising.

3. What we use it for

• So that you can log into your account and play online.
• To show other players what is public in the game: your grower name, your country and province, your image, your results in the rankings, the cup and the map, and your chat messages. Your email is never shown.
• To moderate the game and prevent cheating (fake accounts, bots, real sales).
• To send you account emails: confirmation and password change.
• To send you, now and then, news about the game (for example, a big update). Each of those emails includes a link to unsubscribe: if you click it, we won't write to you again. Unsubscribing doesn't change anything in your account or your game. We don't send third-party advertising or give your email to anyone.

4. Who it is shared with

We do not sell or give away your data. For the game to work, we use the following services, which process the data only for that purpose:

• Supabase: accounts, the database and the images.
• Cloudflare: the web page and the anti-bot check (Turnstile).
• Resend: sending the news emails (it only receives your email and your grower name, to send them to you).
• jsDelivr: serves part of the code and the country flags.

Their servers may be located outside Argentina. We would only disclose data to an authority if required to do so by law or by a judge.

5. For how long

We keep your data for as long as you have the account. If you ask us to delete it, we delete your email, your grower and your saved game within 30 days. Some records may be kept for a longer period if they are needed for security or because of a legal obligation: chat messages that have been reported and the game's attack logs.

6. Your rights

You may request, free of charge, to see what data of yours we hold, to have it corrected or to have it deleted, by writing to contacto@undergrowgame.com from your account email. We will reply within 10 calendar days if you request to see your data, and within 5 business days if you request its correction or deletion, as the law provides. You may request to see your data free of charge every six months, or sooner if you have a legitimate interest (Article 14, paragraph 3, of Law No. 25.326).

The Agencia de Acceso a la Información Pública (AAIP — Agency for Access to Public Information), in its capacity as the supervisory authority under Law No. 25.326, has the authority to handle complaints and claims from those whose rights are affected by non-compliance with personal data protection rules (argentina.gob.ar/aaip).

7. What is stored in your browser

The game stores in your browser your session (so that it does not ask for your password every time), your preferences (volume, radio) and the number mentioned in section 2. We do not use advertising or tracking cookies. If you clear your browser data, these are deleted as well.

8. Minors

The game is only for people aged 18 and over. If you are a parent or guardian and believe that a minor has an account, write to us and we will delete it.

9. Changes

If we change this policy, we will update the date above and, if the change is significant, notify you in the game.
